DNC Motion Quashes Process – DNC Served a Second Time


Here is a brief rundown of the latest in the lawsuit against the DNC.  A motion to quash service of process was granted but the story does not end there.

A court case whose notoriety arose from the death of process server Shaw Lucas and #DNCLeaks hit a speed bump in South Florida. United States District Judge William J. Zloch hit the reset button on the case when he ordered the plaintiffs serve the DNC and Deborah Wasserman Schultz again. The process server for the plaintiffs, Shawn Lucas, filmed the attempted service which turned out not to help his case. 

In the video, the process-server Shawn Lucas says “anyone from the office can accept them” at the 9:50 mark. As it turns out in today’s ruling judge in the DNC case Judge Zloch, that is not the case. At the 10:45 mark this seemly careless statement makes sense as Shawn explains that he normally doesn’t do this type of work but volunteered because of the subject. While this may seem like a stall tactic, service of process is an important part of the legal system. There are very specific rules concerning service of process, and unfortunately, they were not followed in the initial service. Making sure that the right person is given notice of the suit, ensures that the correct people are notified. Similarly, for a corporation, the rules clearly state who is an acceptable person for effecting service.  In this case, the person served was found to not be a valid person for the purposes of service under Florida law. A positive is that this case was not dismissed with prejudice and Plaintiffs can file again.

If the Plaintiffs want to have another volunteer serve the DNC and Deborah Wasserman Schultz; Judge Zloch laid out all the pertinent procedures to follow in his ‘Analysis’ section of his order.
